In April of 2008, Marc F. Bendinelli and W. Joseph Lapham II completed a two week jury trial after an insurance company wrongfully denied insurance coverage to a single mom who suffered very serious injuries. The insurance company refused to do the right thing (despite being given chances to make things right), and continued to mistreat the mother who was having a hard time financially keeping things together for herself and her 2 daughters. Prior to the trial, the insurance company offered $99 to settle the case. After a hard fought two-week long trial (where experts where being flown in from all over the country), the jury returned a verdict in favor of that single mom for $500,000. Upon hearing the jury's verdict, the mom broke down and cried real tears of joy - continually thanking our trial team that worked so hard for her. In 2008, Bendinelli Law Office was privileged to represent a State Trooper who was injured in the line of duty by a careless motorist. That Trooper sustained significant injuries that caused a permanent disability. Bendinelli Law Office was able to resolve that case in a manner that provided award for him and his family without going to trial.

A young man was injured by an 18-wheeler in Fort Collins when he was improperly and negligently crossing the centerline taking his right way. That young man received devastating injuries, but the driver was not wearing a seat belt. Failure to wear a seat belt in accordance with Colorado law acts as a bar to receiving some forms of compensation. Nonetheless, our office was able to achieve a substantial award.

Bendinelli Law Office recently litigated a case against a large insurance company who retained national counsel to defend the lawsuit. The dispute arose out of the bad faith breach of an insurance contract. Our office was able to successfully litigate this claim and receive a substantial award (terms are under confidential settlement).

Bendinelli Law Office was recently selected to represent the victim of a highly publicized drunk driving incident involving a fatality. Our office was able to secure substantial recoverable damages in only four months time.

Our office was also retained to handle a case involving a road-racing incident. The ensuing fatality was publicized by all of the Colorado local news station affiliates. Due to the inflammatory circumstances surrounding road racing, our office was able to obtain the maximum recovery for the family of the deceased minor.

Our attorneys handled a high profile case against a member of the NFL. This case received nationwide coverage relative to the suspension of the player. Bendinelli Law Office was able to achieve a successful confidential settlement.

July, 2010

In July 2010, Marc F. Bendinelli and Sean R. Cumberlege secured a verdict that was 20 times the insurance company’s offer. Our trial team was able to get justice for a nice woman who the insurance company tried to lowball for the last four (4) years.

In July 2010, W. Joseph Lapham II and Joshua D. Stoll won a trial for a lady who the insurance company offered a minimum amount to settle the case. The jury awarded our client twice the amount the insurance company offered. Together with interest and costs, the client’s verdict will be three (3) to four (4) times the offer.

September, 2010

In September 2010, Rebecca Albano tried a hit and run case to a Denver jury, wherein the Defendant alleged that her vehicle had been stolen and then used without her permission, injuring the Plaintiff. The Plaintiff in that case suffered head injuries, property damage and other expenses that the insurance company for the Defendant refused to pay. Ms. Albano, working closely with the investigating police department conducted extensive discovery to obtain evidence that the Defendant was not being truthful about the facts surrounding the incident. Ms. Albano was successful in obtaining a verdict against the Defendant that was nine (9) times the offer from the Defendant’s insurance carrier before trial.
